The Judgment Recovery Specialist
1) As a Judgment Recovery Specialist,
you will locate unsatisfied judgments in your local court or through
special online services I'll tell you about. This is very easy to
do.
2) You will contact the creditor
(by letter or telephone) to remind him or her of the unsatisfied
judgment, and to explain your ability to recover judgments. You
will also tell the creditor how much interest has accrued on the
judgment. Remind them that you are a recovery specialist.
3) You will "take assignment"
on the judgment. Again, this means that you and the creditor agree
to put the judgment into your name. Then you have the authority
to enforce the judgment in pro per. (pro per is short for "in
propia persona," which is Latin for "appearing for oneself"
in court.)
4) You will then conduct your research
to locate your judgment debtor (the JD) and the JD's assets, and
then decide which course of action is the easiest and fastest to
get the judgment paid. This may be through a wage garnishment, bank
levy, assignment order, an abstract of judgment, etc.
5) You will file the appropriate
forms with the court, and direct the levying officer (usually a
sheriff) to seize the assets of the JD. The levying officer will
then turn the assets over to you. Voila! You get paid. You will
then file a Satisfaction of Judgment with the court showing that
the judgment has been paid.
Of course
there are other smaller steps within each of these 5 main steps.
